Drug Courts

There is a general recognition that the “war on drugs” has been a failure. The United States spends more on imprisoning drug offenders than the rest of the world combined. A new tool in dealing with the ravages of drug abuse has been termed “Evidence Based Sentencing” which has been implemented through drug courts. Pockets of society recognize that putting people in prison and throwing away the key is not the best way to combat drug abuse. Instead, research shows that drug treatment and rehabilitation, accompanied by a partnership of close supervision by the court, probation, and social service organizations leads to a substantially lower risk of recidivism. Drug offenders are held accountable but are offered the help to succeed rather than waiting for failure. The policies may be similar but the actual method of practice in Denver Drug Court and Boulder Drug Court are different. Crack Sentencing Changes

Federal Sentencing Guidelines from the 1980s and 1990s resulted in gross disparagement of sentencing between cases involving crack cocaine and powder cocaine. The Federal Sentencing Guidelines Commission and the Fair Sentencing Act of 2010 have changed resulting in significantly reduced sentences for cases involving crack cocaine. The good news is those changes are retroactive and can result in sentence reductions. We can file §3582(c) motion on your behalf to reduce your sentence.
